First-tier Tribunal Judge Rodger has allowed the appeal of AS against the Home Office’s refusal of asylum. AS had been targeted by a powerful family with links to the Egyptian government. In addition, he had participated in sur place demonstrations against the Sisi regime.
Having considered the reports of two experts, and the complex medical history, as well as submissions on behalf of both AS and the Home Secretary, Judge Rodger found that AS would face a real risk of persecution should he be returned to Egypt. It would not be possible to seek the protection of the Egyptian authorities, and internal relocation was not a reasonable option. Further, the sur place activities in themselves gave rise to a real risk of persecution. The appeal was allowed on asylum grounds.
