On 7 July 2023 a district judge ordered the discharge of Gary Dolan’s client following a hearing at Westminster Magistrates’ Court. Gary’s client was wanted by Poland to serve a sentence for a number of historic offences. The district judge found that in respect of an offence of possessing ammunition, dual criminality was not made out. This, coupled with the requested person’s circumstances, meant that extradition amounted to a disproportionate interference with the requested person’s Article 8 rights.
