Lucy Kinder successful in application to dismiss poisoning charge for attempted suicide


Lucy Kinder represented a client who had attempted suicide by gassing themselves in their kitchen.

Lucy submitted two applications to dismiss, the first in response to the original charge of attempted arson being reckless as to whether life was endangered. The Prosecution did not contest this application on the basis that the offence could not be made out.

However instead they introduced a new charge of administering poison so as to endanger life. Lucy again applied to dismiss. Her detailed skeleton argument submitted that no other person had been impacted by the defendant’s actions, no lives had been endangered and the Prosecution could not prove that the gas used was a poisonous substance. 

The Prosecution did not resist the application, offering no evidence at Wood Green Crown Court.
