Abbas Lakha KC defeats Lincolnshire Police’s application for the detention of £650,000 of his client’s cash


Abbas Lakha KC represented a Lincolnshire landlady with a significant portfolio of buy to let properties who was found to have £1 million on cash at her home.

A Lincolnshire Police criminal investigation came to an end after detailed representations were made regarding the source of the funds (rental and sales income) with no criminal charge.

The Economic Crime unit of Lincolnshire Police picked up the case and sought a 6 month extension to the detention order to investigate the criminal provenance and/or criminal use of the same funds. 

That application was defeated at the first hearing followed immediately by an application for the release of the funds under s297 of POCA which was successful with an order for its release “forthwith".
