Gary Dolan has had two results in a week at the Upper Tribunal (Immigration and Asylum Chamber). In MA (Bangladesh) v Secretary of State for the Home Department the Tribunal agreed with Gary's submissions that the decision of the First-tier Tribunal dismissing MA's human rights appeal was vitiated by legal error and should be set aside. Gary, who did not appear at the First-tier, was instructed by direct access. In RR (Sri Lanka) v Secretary of State for the Home Department a judicial panel agreed with Gary's 'able' submissions that the First-tier Tribunal had erred in dismissing RR's asylum appeal. The latter case involved the treatment of medical evidence, the application of the Devaseelan principles, and the Country Guidance case of KK and RS (Sri Lanka) [2021] UKUT 130 (IAC).
