Joey Kwong represents client with intellectual development disorder


Joey Kwong’s client was charged with Possession with intent to supply Class A drugs at Leicester Crown Court.  

The Crown evidence consisted of fingerprint evidence and the client’s admission in interview that he was holding the drugs for another.  

Following Joey’s advice, a fingerprint expert report and a Forensic Consultant Psychiatrists’ report on the client’s vulnerabilities were served upon the Crown. 

The Crown reviewed the reports, decided to continue with the prosecution, and served the client’s interview audio recording to be relied upon at trial. 

Joey therefore lodged a section 76 and section 78 argument to exclude the interview on grounds of unreliability and breaches of PACE. The Crown reviewed the case again, and decided to offer no evidence against Joey’s vulnerable client, saving the client from the distress of a jury trial.
