Joey Kwong, instructed by JD Solicitors, defended a man accused of raping and sexually assaulting his adult step-daughter in the family home. The complainant confronted the client with text messages immediately afterwards, and reported the allegation to the police the next day. Joey made an extensive section 8 application for disclosure, and successfully applied under section 41 / section 100 to cross examine the complainant with her own previous convictions, her other allegations which did not result in charge, medical records and phone records. After cross examining the complainant and her mother with such material, the jury unanimously returned acquittals on all counts.
