Jonathan Akinsanya secures a unanimous acquittal for a Defendant in a 5-day attempted rape trial at Inner London Crown Court.
The complainant alleged that the Defendant had entered her room in the early hours of the morning whilst she was sleeping, jumped on top of her and tried to rape her. In a 999 call she did not mention that the defendant attempted to rape her and when police arrived she reported that both her and the defendant had been drinking, he had touched her inappropriately over her clothing and she had asked him to leave her room which he did.
Twelve (12) hours later she made a report of attempted rape against the Defendant. The Defendant denied he had entered her room in the early hours of the morning and attempted to rape her. He accepted that they had been drinking in her room until the early hours, however he could not remember very much thereafter because he was drunk but he certainly did not enter her room and attempt to rape her.
It should be noted that the complainant had an XL Bully dog in her bed at the time she claimed the Defendant had attempted to rape her.
The jury took less than 2 hours to acquit the Defendant unanimously.
