New Crimeline Extradition Hub Article: Litwinczuk & Others v Poland (Prison conditions in Poland)


On 13 October 2021, Swift J handed down judgment in Litwinczuk, Lukaszek & Tadaszak v Poland [2021] EWHC 2735 (Admin)Litwinczuk marks the Administrative Court’s first consideration of the sufficiency of personal space within Polish prisons since the case of Krolik ([2012] EWHC 2357 (Admin)). In Krolik, the Divisional Court held that Poland complied with its obligations under EU and ECHR law since prisoners were afforded at least 3m2 of personal space (§2,22). Nearly ten years on, Swift J arrived at the same conclusion for similar reasons. See the full article here on Crimeline.
