Sentencing Guidelines Update – expansion to the use of suspended sentences?
The Sentencing Council has published revised guidelines, effective 1 April 2025, which expand rehabilitative and community-based sentencing options. Key points include:
Short and moderate custodial sentences: Even where a moderate custodial sentence threshold is met, courts should consider community orders if they achieve the same sentencing purpose. Rehabilitation, such as addressing addiction, is prioritized over immediate custody.
Suspended Sentences: Suspended custodial sentences can now be considered even for offenders who present a risk to others or have a history of poor compliance with court orders, depending on the potential for rehabilitation.
Community Order Conditions: Maximum curfews have been increased and can now extend to 20 hours a day for up to 24 months.
Pre-Sentence Reports: Courts are advised to seek pre-sentence reports for offenders in specific groups, such as:
- Young adults (18-25 years)
- Ethnic, cultural, or faith minority groups
- Women
- Primary carers for dependents
- Individuals with addiction, chronic health issues, or mental health challenges
- Victims of abuse or exploitation.
