Stefan Hyman acts for the Sovereign Base Areas in an abuse of process case


Stefan Hyman, part of 9BR Chambers’ Extradition and Crime teams, acted for the Chief Constable of the Sovereign Base Areas on the island of Cyprus in a judicial review case concerning abuse of process.

After the Interested Parties’ removal to the Republic of Cyprus was refused on the forum bar, the Resident Judge’s Court concluded that it was an abuse of process to return exhibits belonging to the Cyprus Police to enable a prosecution in Cyprus.

Baumgartner J overturned the Resident Judge’s Court’s decision (read here). Three Judges of the Senior Judges’ Court (Robinson J, Cummings J and Bird J) agreed and dismissed the appeal (read here). The case considers the nexus between extradition/removal refusals and abuse of process.
